- Introduction
This Information Notice has been prepared in order to inform the relevant persons about the principles regarding the collection, recording, use, storage, sharing with third parties, and processing of their Personal Data by our Company, BHM Otelcilik A.Ş., acting in the capacity of Data Controller.
Your personal data that identifies you as an individual or associates you with an identified or identifiable individual is processed in accordance with the Law on the Protection of Personal Data, for the purpose of providing you with better services.
Definitions:
a) Personal Data: Any information relating to an identified or identifiable natural person,
b) Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system,
c) Data Subject: The natural person whose personal data is processed,
ç) Law: The Law No. 6698 on the Protection of Personal Data dated 24/03/2016,
d) Board: The Personal Data Protection Board,
e) Authority: The Personal Data Protection Authority,
f) Registry: The Data Controllers’ Registry (VERBİS) maintained by the Presidency,
g) Processing of Personal Data: Any operation performed on personal data such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, taking over, making available, classifying, or preventing the use thereof, whether fully or partially by automatic means or non-automatic means provided that it is part of any data recording system,
h) Recipient Group: The category of natural or legal persons to whom personal data is transferred by the data controller.
Collected Personal Data We collect and process the following personal data related to you:
- Name and surname,
- Date and place of birth,
- Turkish ID number / passport number,
- E-mail address,
- Phone number,
- Financial data such as credit and/or bank card numbers,
- Nationality, passport, visa, or other identity information issued by governmental authorities,
- Membership or loyalty program data (including co-branded payment cards and travel partner program memberships),
- Employer-related data for business-related reservations,
- Vehicle license plate number,
- Flight, airport transportation, and transfer information,
- Travel itinerary, tour group, or activity data,
- Previous guest stays or interactions, purchased goods and services, special service and convenience requests,
- Social media account identifiers, profile photos, and other publicly available data, as well as data made available by linking your social media and loyalty accounts,
- Information regarding family members and companions, including the names of companions and ages of children,
- Image, video, and audio data obtained through security cameras/recording devices located in public areas of our facilities such as corridors and lobbies,
- Your preferences shared with us, including your interests, in order to make your current and future stays and experiences with us more enjoyable,
- Your likes, opinions, comments, and feedback regarding our services, as well as nutritional information necessary for your health, health restrictions, and/or personal requirements,
- Your preferences regarding special occasions such as birthdays or wedding anniversaries, your hobbies, and activities you wish to participate in,
- In case you make a reservation on behalf of another person, the personal data you share regarding such person(s).
C. Collection, Processing, and Purposes of Processing Personal Data Your personal data shared with our Company is used for the following purposes, limited thereto:
- Fulfillment of obligations arising from legislation, primarily the Law No. 1174 on Identity Notification, Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through Such Publications, Law No. 213 on Tax Procedure, and Law No. 6102 on the Turkish Commercial Code,
- Conducting reservation and guest registration procedures, providing on-site welcome and accommodation services,
- Organizing and managing daily use, organizations, seminars, and events at our facilities and/or establishments,
- Customizing and offering products and services provided by our Companies in line with our guests’ preferences, usage habits, and needs,
- Creating commercial statistics and analyses regarding visits to and use of our facilities’ websites or social media channels/platforms,
- Informing you about events, organizations, seminars, trainings, and talks organized at our facilities and/or establishments,
- Providing information regarding the information, events, and services you request from our Companies,
- Carrying out necessary activities to enable you to benefit from our products and services,
- Conducting market research and R&D (research and development) activities, as well as improving and developing our product range, services, stores, information technology systems, and security systems, and ensuring information security,
- Determining the fees of our products and services and carrying out invoicing and payment processes,
- Making notifications regarding all kinds of loyalty programs and memberships implemented and/or to be implemented by our Companies and affiliated companies/organizations, and informing you about new services and products, changes, innovations, and similar matters in loyalty programs and/or membership terms,
- Improving the quality of services offered by our Company and developing our quality policy,
- Informing you about and enabling you to benefit from general and special campaigns, promotions, advertisements, discounts, and similar advantages offered by our Company,
- Determining and implementing our Company’s commercial and business strategies,
- Ensuring the security of our facilities and individuals present therein, and assisting in the prevention, detection, investigation, and prosecution of crimes,
- Obtaining legal consultancy services and conducting contract processes related to procurement of goods and services and leasing/lease transactions for the prevention and resolution of disputes encountered or to be encountered within the scope of our Company’s commercial activities,
- Establishing and maintaining commercial, lease, and similar legal relationships in line with our Company’s procurement of goods and services and needs,
- Ensuring the security of our Company, guests, employees, and third parties including those having business relations with our Company (administrative operations, ensuring and supervising physical security of facilities, business partner/customer/supplier evaluation processes, legal compliance process, financial affairs, etc.),
- Providing information regarding availability and prices at our facilities, making reservations and/or using reservation cancellation via our call center or website,
- Emergency and incident response, Receiving, evaluating, and following up on your requests and complaints.
Method and Legal Basis for Collecting Personal Data: Your personal data are collected, within the scope of the purposes listed above, based on the legal grounds set forth in Article 5, paragraph 2 of the Law on the Protection of Personal Data, namely:
- where it is explicitly stipulated by law,
- where the processing of personal data belonging to the parties to a contract is necessary, provided that it is directly related to the establishment or performance of a contract,
- where it is mandatory for the data controller to fulfill its legal obligations,
- where data processing is mandatory for the establishment, exercise, or protection of a right,
- where processing is necessary for the legitimate interests of our Company as the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person.
Based on these legal grounds, your personal data are collected verbally, in writing, or electronically, through automatic or non-automatic methods, via websites, call centers, social media channels, agencies, intermediaries, mobile applications, and similar means.
Force Majeure: Within the scope of measures taken or required to be taken in cases of force majeure such as COVID-19 and similar global or regional pandemics, infectious diseases, earthquakes, floods, wars, and states of emergency; your personal and/or special categories of personal data may be processed, including symptom information (fever, loss of smell, shortness of breath, etc.), chronic illness, allergy and pregnancy status, medications used and previous treatment information, health data such as blood pressure, pulse, respiration and body temperature, HES code information, vaccination card information, PCR test results, special permit documents issued under the circulars published by the Ministry of Interior of the Republic of Türkiye, and personal and/or special categories of personal data requested pursuant to the decisions of Ministries and the Presidency, for the following purposes:
- protection of public health,
- ensuring a healthy environment in our company’s business and facility buildings in accordance with requirements such as safe tourism certification,
- monitoring the health status/disease risk of our guests and visitors, and carrying out medical diagnosis, treatment, and care services,
- implementation of isolation/quarantine processes notified by Ministries and provision of preventive healthcare services,
- ensuring compliance with national and international legislation to which our facilities are subject and fulfillment of obligations arising from the relevant legislation,
- compliance with the rules determined by national/international health authorities,
- carrying out arrangements and notifications regarding your accommodation/visit and processes such as refund/postponement/cancellation related to your reservation,
- ensuring the continuity and conduct of our business activities.
Transfer of Personal Data: We may transfer/share your personal data with third parties included in the following recipient groups:
- Service Providers: We may share data in relation to services such as website operations, data analysis, order/payment transactions, reservation and reservation confirmation processes, customer services, e-mail delivery, and marketing.
- In-Facility Service and/or Agency Providers: When you stay at or visit one of our affiliated facilities, we may share your information related to services such as spa, restaurant, café, bar, health club, concierge, and other sales points within our facilities so that they may provide you with marketing services.
- Contracted Organizations: We may share your data with airlines, car rental companies, travel agencies, and similar real and/or legal persons to enable you to benefit from their services for purposes such as receiving discounted services or
facilitating service procurement during your use of our facility.
- Group Companies: We may share your data with other companies within Barut Hotels in order to personalize the services and products we will offer to you, facilitate your transactions, communicate with you, enable you to benefit from our loyalty programs, and achieve our business objectives.
- Suppliers and Service Providers: Where necessary to make products and services available for your use, we may share data with real and/or legal persons such as reservation service providers, Wi-Fi and Wi-Fi interface providers, secure payment systems, insurance companies, transfer companies, and travel agencies.
- Consultants: We may share data for purposes such as legal, financial, and investment planning, risk identification, and execution of business processes.
- Financial Institutions: We may share data for the execution of payment transactions and investment processes.
- Public Institutions: We may share data for the fulfillment of obligations arising from legislation, protection of public health, ensuring security, prevention, detection, and investigation/prosecution of crimes, and prevention of force majeure situations.
In addition, due to reasons such as server systems, cloud storage systems, banks’ payment systems, and the fact that intermediary organizations through which reservations are made may have headquarters in different countries, your personal data shared for reasons such as reservations and visits to our facilities may be transferred to other countries.
- Rights of the Data Subject as the Relevant Person:
As the relevant person, by applying to our Company, you have the right to:
- Learn whether your personal data are processed, and if so, to request information regarding such processing,
- Learn the purpose of processing of personal data and whether they are used in accordance with that purpose,
- Know the third parties to whom personal data are transferred domestically or abroad,
- Request correction of personal data if they are processed incompletely or inaccurately,
- Request deletion or destruction of personal data if the reasons requiring processing no longer exist, and to request notification of such actions to third parties to whom the data have been transferred,
- Request compensation for damages in case of loss arising from unlawful processing of personal data.
Requests regarding the rights of the relevant persons and the implementation of the Law may be submitted in writing to the address “Şirinyalı Mah. Lara Cad. No:24 Muratpaşa / Antalya.” If the response to such requests is provided in writing, our Company shall not charge a fee for up to ten pages; for each page exceeding ten pages, a processing fee of 1 Turkish Lira per page shall be charged. If the response is provided on a recording medium such as a CD or flash drive, the fee shall not exceed the cost of the recording medium as determined by the Personal Data Protection Authority.

Collection, Processing and Purposes of Processing of Personal Data:
Our Companies’ policy on the protection and confidentiality of personal data has been prepared in compliance with the KVK Law. Accordingly, your personal data may be collected verbally, in writing or electronically, through automatic or non-automatic methods, via offices, branches, dealers, call centers, websites, social media channels, mobile applications and similar means, depending on the services, products or commercial activities provided by our Companies. As long as you benefit from our products and services, your personal data may be processed by being created and updated.
In addition, your personal data may be processed when:

f) Making notifications regarding loyalty cards and website memberships issued and/or to be issued by our Companies and their affiliated companies/organizations (renewal, expiration, etc.), communicating with you, and informing you about new services and products as well as changes in personal data policies and membership terms,
g) Ensuring the legal and commercial security of our Companies and individuals having business relations with our Companies, h) Managing security operations, accidents or other similar medical or insurance-related incidents,
i) Conducting market research and R&D activities and improving our product range, services, stores, information technology systems and security systems,

Your personal data are obtained in any verbal, written or electronic environment, in line with the purposes stated above, in order for the Companies to provide our products and services within the determined legal framework and to fully and accurately fulfill the contractual and statutory obligations of our Companies within this scope. Personal data collected based on this legal ground are processed, recorded, transferred, shared and stored for the purposes specified under Article (B) of this text, within the scope of the personal data processing conditions and purposes set forth in Articles 5 and 6 of the Law on the Protection of Personal Data.

Processing of Special Categories of Personal Data
In Article 6 of the Turkish Personal Data Protection Law (“KVK Law”), certain personal data which carry the risk of causing individuals to suffer harm or discrimination when processed unlawfully are defined as special categories of personal data. These data include race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, clothing and appearance, membership of associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data. Our Companies act in compliance with the regulations stipulated in Article 6 of the KVK Law regarding the processing of special categories of personal data and exercise due care in the protection of such data.
Our Companies process special categories of personal data in accordance with the KVK Law, provided that adequate measures determined by the Personal Data Protection Board are taken, under the circumstances set out below:
Where the Data Subject Has Given Explicit Consent
Our guests may request customized services by sharing their circumstances with our Companies and may share their special categories of personal data for this purpose (for example, requesting a thin pillow due to a cervical disc herniation, requesting a room on the entrance floor due to a heart condition, requesting desserts without nuts due to a peanut allergy, etc.). In order to provide customized services in line with the needs defined by our guests through the sharing of their special categories of personal data and to remember these needs in the future in order to provide the same services again, our Companies shall process special categories of personal data only by obtaining the explicit consent of the relevant person and solely for the purpose of serving the purpose of collection.
Where the Data Subject Has Not Given Explicit Consent
- Special categories of personal data other than health and sexual life may be processed in cases stipulated by law.
- Special categories of personal data relating to health and sexual life may only be processed by persons or authorized institutions and organizations under a duty of confidentiality, for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, and the planning and management of healthcare services and their financing.
Force Majeure
Personal data and special categories of personal data may be processed within the scope of measures taken or required to be taken in cases of force majeure such as COVID-19 and similar global or regional epidemics, infectious diseases, earthquakes, floods, war, or states of emergency.
To Whom and For What Purpose Processed Personal Data May Be Transferred
Your collected personal data may be transferred to the Akra Companies listed below in order to serve the purposes specified in Section (B):

In addition, such data may be transferred to our shareholders, business partners, suppliers, legally authorized public institutions and private persons within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVK Law.
Transfer of Personal Data Abroad
Our Companies are authorized to transfer personal data abroad in accordance with the conditions determined by the Personal Data Protection Board under the KVK Law, in compliance with other conditions set forth in the law, and after obtaining the explicit consent of the person for this purpose.
Rights of the Personal Data Subject Listed in Article 11 of the KVK Law
Within the scope of the KVK Law, we acknowledge that the relevant person has the right to be informed and to give consent prior to the processing, recording, transfer, sharing, and storage of their personal data, and the right to determine the fate of their data after such processing activities. Accordingly, if personal data subjects submit their requests regarding their rights to our Companies using the methods set out below in this “Personal Data Processing Information Notice,” our Companies shall finalize such requests free of charge within a maximum of thirty (30) days, depending on the nature of the request.
Pursuant to the Communiqué on the Procedures and Principles of Application to the Data Controller published by the Personal Data Protection Board:
- If a written response is provided, no fee shall be charged for up to ten (10) pages. For each page exceeding ten pages, a processing fee of 1 Turkish Lira may be charged.
- If the response is provided on a recording medium such as a CD or flash drive, the fee that may be requested by our Companies as data controller shall not exceed the cost of the recording medium.
Within this scope, personal data subjects have the right to:
a. Learn whether personal data are processed,
b. Request information if personal data have been processed,
c. Learn the purpose of the processing of personal data and whether they are used in accordance with their purpose,
d. Know the third parties to whom personal data are transferred domestically or abroad,
e. Request correction of personal data if they are processed incompletely or inaccurately and request notification of the transaction to third parties to whom the personal data have been transferred,
f. Request the deletion, destruction, or anonymization of personal data within the framework of the conditions stipulated in Article 7 of the KVK Law and request notification of the transaction to third parties to whom the personal data have been transferred,
g. Object to the occurrence of a result against the person by analyzing processed data exclusively through automated systems,
h. Request compensation for damages arising from the unlawful processing of personal data.
However, individuals have no rights regarding anonymized data within the Companies. Our Companies may share personal data with relevant institutions and organizations for the purposes of fulfilling judicial duties or enabling state authorities to exercise their statutory powers, arising from business and contractual relationships.
Retention Periods of Personal Data
In accordance with the KVK Law, personal data processed for the purposes specified in this “Personal Data Processing Information Notice” shall be deleted, destroyed, or anonymized by our Companies when the purpose requiring processing ceases to exist pursuant to Article 7/1 of the KVK Law and/or when the statutory limitation periods during which we are obliged to process such data under applicable legislation expire.
Circumstances in Which Our Companies May Process Your Personal Data Without Your Explicit Consent as Required by Law
Pursuant to Article 5 of the KVK Law, our Companies may process your personal data obtained lawfully and specified above without seeking your explicit consent in the following cases:
- Where explicitly stipulated by law,
- Where processing is mandatory to protect the life or physical integrity of the data subject or another person in cases where the data subject is unable to express consent due to actual impossibility or where consent is not legally valid,
- Where processing is directly related to the establishment or performance of a contract to which you are a party, provided that it is necessary to process personal data of the parties to the contract,
- Where processing is mandatory for our Companies to fulfill a legal obligation,
- Where personal data have been made public by the data subject,
- Where processing is mandatory for the establishment, exercise, or protection of a right,
- Where processing is mandatory for the legitimate interests of our Companies, provided that it does not harm the fundamental rights and freedoms of the data subject.
How to Submit a Request Under the Personal Data Protection Law
Pursuant to Article 13/1 of the KVK Law, you may submit your request regarding the exercise of the rights specified above to our Companies in accordance with the procedures set out in the KVK Law, relevant legislation, and the methods determined or to be determined by the Personal Data Protection Board. You may also submit your request by completing and signing the Application Form available at https://www.akrahotels.com/KVKK and applying through one of the following methods:

iii. You may submit the completed form and identity documents electronically with a secure electronic signature or mobile signature to hukuk@bhmotelcilik.com, or
iv. You may submit the completed form and identity documents by using the electronic mail address previously notified to our Companies and registered in our systems.
Our Companies shall finalize your request within a maximum of thirty (30) days, depending on the nature of the request.
Requests regarding personal data rights may only be exercised concerning the data belonging to the individual making the request. Requests regarding the personal data of third parties shall not be taken into consideration. Applications submitted without documents verifying identity shall not be considered. Even if data deletion requests are fulfilled, we inform you that we are obliged to share such data with official authorities if requested by them.
